HB 1159 Bill
In 2019 the HB 1159 bill was passed in the state of Florida. This bill allows private property owners to trim, remove or prune their trees without a permit or application fee from the local government. This was a significant step for Florida residents. With hurricane season wreaking havoc on properties across the state from June 1st – November 30th, residents can now take safety precautions into their own hands with the help of a certified arborist. Here are a few snapshots from the bill such as:
- The local government will not require the property owner to replant the tree which was pruned, trimmed, or removed
- Property owners adjacent to an electrical utility right of way can ask for vegetation maintenance without local government approval
- The local government is prohibited from requiring notice, an application fee, or mitigation for pruning, trimming, or tree removal on the residential property so long that the resident receives documentation from a certified arborist that the tree is a danger.
Considerations
Of course, there are always other situations to consider when discussing trimming, pruning, or removing a tree on the property. For example, what if your neighbor’s tree branches fall over your property line? In the state of Florida, you are legally allowed to trim the branches which extend past the property line, no further. What if you live in an HOA? An HOA also known as a homeowner’s association might have strict rules and regulations when it comes to trimming, pruning or removing trees on your property.
